The basis of our assertion
Our statement asserts an exemption from the record-keeping requirements of 18 U.S.C. 2257, 2257A and 28 C.F.R. 75 for artificially generated depictions, rather than recordings of actual people performing sexually explicit acts. Our stated basis is that no human models or performers appear in those generated images.
A specific position, not general approval
Our assertion is not an independent certification, a court decision or government approval. It does not exempt content from every other law or rule, or independently determine whether a particular image qualifies for a legal exemption.
Age restrictions still apply
Adult-content access remains age-restricted. Our age policy prohibits generating material resembling minors or exploiting their likeness, and provides for moderation, account suspension or termination. AI generation does not cancel those restrictions or your responsibility for the resulting content.
Raise a specific likeness concern
Use the Content Removal Policy if generated material appears to resemble a real person. Support may require evidence of identity or relationship before validating a request. That process addresses the likeness concern, not the broader exemption position.
